Quick Hits (page 4)Canadian Court Rules Kubby Not a FugitiveBy: Kubby.org email list Former California gubernatorial candidate Steve Kubby was cleared on Friday of any violations of Canadian Immigration law. Canadian Federal Court Adjudicator D. Shaw Dyck found that Kubby had entered Canada legally. Adjudicator Dyck also ruled that because of alleged political persecution in the United States, Kubby was eligible to apply for Canadian citizenship as a U.N. Convention political refugee. The refugee appeal process is expected to take at least a year and could take a lot longer, as has been the case with Renee Boje, who has been waiting several years for a final decision on her political refugee status. Adjudicator Dyke also ruled that since Kubby was not a fugitive, he no longer has to report weekly to Immigration and can now report monthly instead. Dyke stated that possession of peyote is legal under Canadian law, so Kubby's U.S. conviction for peyote possession has no legal standing in Canada. The adjudicator also noted Kubby "has been completely honest and up front with Canadian Immigration and in view of his public statements and permission from the Placer court to move to Canada, is hardly a fugitive." Dyck also noted that possession of live mushrooms is legal and only the dried form is illegal, in Canada. She also acknowledged that possession of a small amount of dried mushroom would probably not be prosecuted in Canada. However, since Kubby was convicted in the U.S. of something that was technically illegal in Canada, she was required to declare Kubby inadmissible until the sentence for the mushroom stem had been served. The prosecution for the Canadian Immigration Service then argued that Kubby should be immediately deported to face his U.S. sentence of 120 days. He argued that Placer Judge John Cosgrove had gone out of his way to be compassionate to Kubby, even providing written orders that Kubby be allowed to be protected by the Compassionate Use Act while under house arrest and probation. Kubby's immigration attorney, Alex Stojicevic, responded that although the US court recognized Kubby's right to possess and use medical marijuana, local and federal law enforcement blocked any access to it. Stojicevic argued that Kubby was not allowed to grow any of his own medical marijuana forcing him and others to buy and transport the medicine to his home. Since the courts have ruled that transportation is not covered under the Compassionate Use Act, Kubby was physically and legally unable to comply with his sentence. Stojicevic explained to the Canadian judge that there was ample scientific and medical evidence to show that Kubby would die if denied his medical marijuana for more than a few days -- "so despite the trivial nature of his conviction, he faces death if he returns to the U.S." "Mr. Kubby is a member of a particular social group or political opinion who are being persecuted in the United States. As such he is entitled to apply as a political refugee under the UN Convention, which is recognized by Canada." said Stojicevic. Adjudicator Dyck then ruled that Kubby met the qualifications and was qualified to apply along with his family for Canadian citizenship. Kubby joins three other Americans who have officially applied for political refugee status in Canada: Ken Hayes, Steve Tuck and Renee Boje. "Once again my husband was jailed and nearly killed over charges that proved groundless. A Canadian court has confirmed that Steve is not a fugitive and I think the Canadian police and courts now recognize that they were lied to by Placer County officials," said Michele Kubby. The Invocation Hello brethren. I looked brethren up in Webster's dictionary. When I got to brethren it sent me to brother where I then read: A lay member of a men's religious order. Now then brothers and sisters. If brethren leads to brother, which then leads to a lay member of a men's religious order; why does sister lead directly to nun, without having any sistren? Have the women been slighted once again? Another thing of note that I discovered. The word preceding brother, in my Webster's II New Riverside Dictionary, is brothel. Brothel.... a house of prostitution. What could any of this have to do with me preaching to you, here on the privacy of your screen? If in fact it is private and is not a mind control device that has been handed to our leaders by an alien life force. Don't hit that delete button!! All of the elements exist in our society to make Shayreen's story credible. Although I can, and do, assure you that it is not a situation we have all found ourselves in. Shayreen's story takes place at the Playboy mansion. The mansion sets us up with the necessary ingredients. Yep, you guessed it sex and drugs. If a person wants a person of a different ethnicity for those same reasons of desire and need, then they should strive to find a person of that ethnic background. Children that, in some cases, are not old enough to know what is going on. What impact will the egregious use of these innocent children have on their developing psyches? What are those children thinking? How will they deal with the sexual issues when they come of age? Will they be scarred, emotionally and functionally? Will their sexuality be for ever traumatized ? As victims will they sue the church for sexually traumatizing their childhoods? Let us all pray together, right here and now, for these children. Pray that, in spite of the trauma they've experienced at the hands of religious zealots, these children will grow up to know the subtle nuances of a vibrator, a sensual massager, a dildo, a vibrating dildo, a butt plug, a cock ring, a lap dance, a table dance and etc. etc. Pray that they enjoy consensual mutual sexual contact to its fullest. I haven't met any of those men, but it is possible. Those are the issues that we confront on a daily basis. We need to resolve them in our hearts with understanding and compassion. We need to do this post haste. Our petty in house bickering must come to a stop. Why? A young Palestinian girl straps a set of bombs to her body, walks to a crowded corner and, blows it and herself to dust. Was the known reality of her life so destitute and bereft of purpose as to be meaningless? Is a promise of a better afterlife a justification for the preemptive taking of your own life for a cause? We all do hope that there is a better afterlife. We need it to exist. That is where our departed friends and family are. Rest assured my friends it is there. Perhaps not in any form that you have as of yet had described to you, but there is an afterlife. It is called death. With a new reality descending upon us in our current state of terrorist induced enlightenment, it is time to settle the sex issue. It is quite easily resolved. I'm writing about a bill in congress, HR 2592, " 'States' Rights to Medical Marijuana Act'," a bill to provide for the medical use of marijuana in accordance with the laws of the various states. This bill is sponsored by Congressman Barney Frank, Democrat, from Massachusetts and the primary cosponsor is Congressman Ron Paul, Republican, from Texas. Does this bill allow the ordinary citizen to grow, transport, possess, market, sell and use marijuana? No. Does this bill remove marijuana and THC from the federal controlled substance statute? No. Does this bill remove authority from the DEA over cannabis, hemp, marijuana and THC? No. Does this bill remove authority from the U.S. Attorney General to place marijuana back as a schedule "I" drug? Maybe and maybe not. On that particular point, the bill is somewhat vague. What a winner. Then just exactly what does this bill do? Not very much. It reclassifies marijuana from a schedule "I" drug to a schedule "II" drug. It allows doctors to prescribe or recommend marijuana to patients and patients only. Lastly it allows for the production, importation and storage of marijuana "for the purpose of producing marijuana for prescription or recommendation by a physician for medical use from producing and distributing marijuana for such purpose." As I wrote for the title of this paper, what a joke. This bill is, at best, a sham. I have no idea who specifically asked Congressman Frank or Congressman Paul to sponsor this sham, but whoever came up with this abortion ought to be taken out and shot. This joke does not do anything, as in nothing, for those who are incarcerated. This joke does nothing for those who lost their property -- because, purportedly, something could be traced to a drug deal. This joke does not restore rights and privileges to those who have suffered pains and penalties under our current and most misguided law. Lastly, this bill does not remove marijuana and THC from the controlled substance schedule. An act of congress is all it takes to fix the problem, to right the numerous wrongs committed by government against those who, for whatever reason, choose to partake in the weed of life. An act of congress is not all that difficult an achievement. It happens all the time, normally at the expense of our liberty. Consider that the prohibition of marijuana became law in one fell swoop. Why should the law not be repealed in the same manner? The fact is it can be repealed in exactly the same manner as it was enacted. For that matter to draft a bill just to reclassify marijuana is this easy: Cannabis Restoration Act
Gee, that wasn't very hard now was it? And I'm not a lawyer. The hard part of any legislation is getting it passed -- in its original form. No amendments, no riders. Plus getting the votes needed for passage and figuring out how to get the chief executive to sign it into law. However, if we win, we win it all. The flip side is if I am going to fail, I would rather fail completely than have a politically correct, yet morally wrong, piece of trash get signed into law. Marijuana has been proscribed since the 1930's. It became a schedule "I" drug in the 1970s and nobody has been able to get that changed. Period. So now some person or organization got two congressmen to introduce a politically correct, watered down joke. And what is happening with this poor joke? It is languishing in committee -- since July of 2001. A real barn burner can't you tell. The absolute worst part of HR 2592 is that the United States Attorney General, via petition, can possibly reclassify marijuana back to a schedule "I" drug. It appears HR 2592 has no provision for limiting the Attorney General's authority in that regard. Hence, should HR 2592 become law tomorrow (not a very likely prospect though) the AG could conceivably reclassify marijuana back to schedule "I" status the day after. How politically correct. Secondly, THC is not reclassified. Yes, I understand THC is a part of marijuana. However, under the controlled substance schedule, marijuana is one line number and, believe it or not, THC is another. So, under HR 2592, should it pass (snicker), a medical user could use marijuana legally and be arrested for possession and use and transportation of THC. What a bargain. I'll say it again, what a joke. What about hemp? The bill makes no mention of hemp. Hence, one could reasonably assume that hemp, under DEA regulation, would remain in dire straits and possibly illegal. In essence HR 2592 is another feel good piece of garbage. Hopefully, it shall never see the light of day, at least as law. Furthermore, those who created it should hang their heads in outright shame.
