Officer of the Court Opinions by Medical Marijuana Attorney

Officer of the Court legal opinions by William R. Mcpike, Attorney at Law

We all know everyone has an opinion, but these opinions carry legal weight. Judges, prosecutors and police can pay attention to them. It is called judical notice.

An Officer of the Court legal opinion is a legal paper written:

  • By a licensed attorney.
  • For a specific person.
  • For a specific purpose.
  • Specifying that the person for whom it was prepared for is, in the opinion of the officer of the court, in full compliance with the law.

With the current legal climate in California over medical marijuana and patient rights an officer of the court opinion may prevent:

  • Search.
  • Seizure.
  • Arrest.

Should police decide in the face of the opinion to arrest anyway, the opinion becomes defense evidence of:

  • Due diligence.
  • Expert witness.
  • Violation of civil and legal rights by police.
  • Harassment.

This opinion can also be used in civil suit litigation for violation of civil and legal rights.

Cost:

  • $250.00.

In the more recent Ainsworth case McPike won a full dismissal for his clients -- before arraignment -- including related felony firearm charges.

Mr. McPike is an active member of the NORML Legal Committee (NLC).
